1. What information do we collect?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The personal information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:
- Names
- Phone numbers
- Email addresses
- Business name (for bar and restaurant owners)
- The content of any message or request you send us
Sensitive Information. We do not process sensitive information.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information, such as usage data and general device information, is collected automatically when you use the Services.
We automatically collect certain information when you use FindHappy, such as which deals and pages you view and interact with, general device and browser information, and your IP address. We also store a randomly generated identifier in your browser so we can measure anonymous usage (for example, how many people viewed a deal) without identifying you.
Location information
In Short: We collect approximate location only with your permission.
If you allow it, we use your device's approximate location to show happy hours near you and sort them by distance. This is generally used within your browser or device. You can turn it off at any time in your browser or device settings, and the map still works without it.
2. How do we process your information?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To deliver and facilitate delivery of the Services, including showing live happy hours, flash deals, and live music, and listing or claiming bars.
- To respond to user inquiries and offer support.
- To send administrative information to you, such as changes to our terms and policies.
- To send you text-message deal alerts that you have opted in to. You can opt out at any time by replying STOP; message and data rates may apply.
- To protect our Services, including fraud monitoring and prevention.
- To identify usage trends so we can better understand how the Services are used and improve them.
- To save or protect an individual's vital interest, such as to prevent harm.
3. What legal bases do we rely on?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.
If you are located in the EU or UK, this section applies to you.
The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on to process your personal information. We may rely on the following:
- Consent. We may process your information if you have given us permission to use it for a specific purpose. You can withdraw your consent at any time.
- Performance of a Contract. We may process your information when necessary to fulfill our contractual obligations to you, including providing our Services.
- Legitimate Interests. We may process your information when reasonably necessary to achieve our legitimate business interests, such as to analyze how our Services are used so we can improve them and to diagnose problems or prevent fraudulent activities.
- Legal Obligations. We may process your information where necessary for compliance with our legal obligations, such as cooperating with law enforcement or a regulatory agency, or exercising or defending our legal rights.

4. When and with whom do we share your information?
In Short: We may share information in specific situations described in this section and with the following categories of third parties.
Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us and require access to such information to do that work. We have contracts in place designed to safeguard your personal information; they cannot do anything with it unless we have instructed them to, and they may not share it with any organization apart from us.
The categories of third parties we may share personal information with are:
- Sales and marketing tools, including our CRM
- Data storage service providers
- Website hosting service providers
- Cloud computing services
- Communication and collaboration tools, including our text-message delivery provider
When you submit the bar-owner claim form, your details are stored in our database and shared with our CRM to manage and follow up on your request.
We also may need to share your personal information in the following situations: Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
We do not sell your personal information, and we do not share it for cross-context behavioral or targeted advertising.
5. Do we use cookies and other tracking technologies?
In Short: We use limited browser storage for essential features. We do not use advertising or cross-site tracking cookies.
FindHappy is deliberately light on tracking. We use your browser's local storage for functional purposes, such as remembering your device for anonymous analytics, your saved venues, whether you have seen our pilot notice, and your location preference. We do not serve targeted advertising and do not use third-party advertising or cross-site tracking cookies. 6. Do we offer artificial intelligence-based products?
In Short: We do not currently offer AI-powered products or features to users of FindHappy.
FindHappy does not provide consumer-facing artificial intelligence products, and we do not feed the personal information you provide through FindHappy into third-party AI models for those purposes. If this changes, we will update this notice.
7. How long do we keep your information?
In Short: We keep your information only for as long as necessary for the purposes set out in this notice, unless a longer period is required or permitted by law.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because it is stored in backup archives), we will securely store it and isolate it from any further processing until deletion is possible.
8. How do we keep your information safe?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Transmission of personal information to and from our Services is at your own risk, and you should only access the Services within a secure environment.
9. Do we collect information from minors?
In Short: No. FindHappy is intended for adults of legal drinking age, and we do not knowingly collect data from anyone under 21.
FindHappy is about happy hours and deals at bars and restaurants and is intended for adults of legal drinking age (21 or older in the United States). We do not knowingly collect, solicit data from, or market to anyone under 21, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 21. If we learn that personal information from a person under 21 has been collected, we will take reasonable measures to promptly delete such data. If you become aware of any data we may have collected from someone under 21, please contact us at contact@modwize.io.
10. What are your privacy rights?
In Short: Depending on your state of residence in the US, or in regions such as the EEA, UK, and Switzerland, you have rights that allow you greater access to and control over your personal information.
In some regions (like the EEA, UK, and Switzerland), you have certain rights under applicable data protection laws. These may include the right to request access and obtain a copy of your personal information, to request rectification or erasure, to restrict the processing of your personal information, to data portability, and not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make a request by contacting us using the details in section 14. We will consider and act upon any request in accordance with applicable data protection laws.
If you are located in the UK and are unhappy with how we have handled your personal information, you can make a complaint directly to us by email at contact@modwize.io or by post at the address in section 14. This is in addition to your rights under the UK GDPR and the Data Protection Act 2018.
What happens after you complain: we will acknowledge your complaint within 30 days of receiving it, investigate without unjustifiable or excessive delay, and keep you informed of progress and the outcome. If you are not happy with our final response, you can refer your complaint to the Information Commissioner's Office (ICO), the UK supervisory authority (ico.org.uk/make-a-complaint; helpline 0303 123 1113; post: Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF).
If you are located in the EEA or UK and believe we are unlawfully processing your personal information, you also have the right to complain to your Member State or UK data protection authority. If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.
Withdrawing your consent: if we are relying on your consent to process your personal information, you have the right to withdraw it at any time by contacting us using the details in section 14. This will not affect the lawfulness of processing before the withdrawal. You can also opt out of text-message alerts at any time by replying STOP.

11. Controls for Do-Not-Track features
Most web browsers and some mobile operating systems and applications include a Do-Not-Track ("DNT") feature you can activate to signal your preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard is adopted in the future that we must follow, we will inform you in a revised version of this notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
Global Privacy Control: we recognize and honor Global Privacy Control (GPC) signals. If you use a browser or extension that supports GPC, we will treat this as a valid request to opt out of the sale or sharing of your personal information for targeted advertising under applicable state privacy laws, including the CCPA. 12. Do United States residents have specific privacy rights?
In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and details about the personal information we maintain about you, to correct inaccuracies, to get a copy of, or to delete your personal information, and to withdraw consent. We may also collect other personal information outside of these categories where you interact with us in person, online, or by phone or mail, such as when receiving help through our support channels, participating in surveys, or in the delivery of our Services. How we use and share personal information
We collect and share your personal information through our service providers, as described in section 4. We do not use targeting or advertising cookies, beacons, or pixels.
We have not sold or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We have disclosed the following categories of personal information to service providers for a business or commercial purpose in the preceding twelve (12) months: Category A (Identifiers), Category F (Internet or other network activity), and Category I (Professional or employment-related information, for owners).
Your rights
You have rights under certain US state data protection laws. These rights are not absolute, and in certain cases we may decline your request as permitted by law. They include:
- Right to know whether or not we are processing your personal data
- Right to access your personal data
- Right to correct inaccuracies in your personal data
- Right to request the deletion of your personal data
- Right to obtain a copy of the personal data you previously shared with us
- Right to non-discrimination for exercising your rights
- Right to opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling that produces legal or similarly significant effects (we do not engage in these activities)
Depending on the state where you live, you may also have the right to access the categories of personal data being processed, to obtain a list of the categories or specific third parties to which we have disclosed personal data, to review and question how personal data has been profiled, and to limit the use and disclosure of sensitive personal data, as permitted by applicable law.
How to exercise your rights
To exercise these rights, email us at contact@modwize.io. We will honor your opt-out preferences if you enact the Global Privacy Control (GPC) signal on your browser. You may designate an authorized agent to make a request on your behalf; we may deny a request from an agent who does not submit proof that they have been validly authorized to act on your behalf.
Request verification
Upon receiving your request, we will need to verify your identity to confirm you are the person about whom we have information. We will only use personal information provided in your request to verify your identity or authority to make it. If we cannot verify your identity from the information we already maintain, we may request additional information for verification and for security or fraud-prevention purposes.
Appeals
If we decline to take action regarding your request, you may appeal our decision by emailing us at contact@modwize.io. We will inform you in writing of any action taken or not taken and the reasons for it. If your appeal is denied, you may submit a complaint to your state attorney general.
California "Shine The Light" law
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. To make such a request, contact us using the details in section 14.
13. Do we make updates to this notice?
In Short: Yes. We will update this notice as necessary to stay compliant with relevant laws.
The updated version will be indicated by an updated "Revised" date at the top of this notice. If we make material changes, we may notify you by prominently posting a notice of the changes or by directly sending you a notification. We encourage you to review this notice frequently.
